Albertsons Cos. Inc. (NYSE: ACI) scored a legal win in its attempt to issue a special dividend ahead of its $25 billion sale to Kroger Co (NYSE: KR). Last week, King County Superior Court Judge Ken Schubert ruled against Attorney General Bob Ferguson's lawsuit to block Albertsons from issuing the $4 billion special payment to its shareholders. Though, it will remain in effect until Dec. 19, as Ferguson's office appeals to the Washington State Supreme Court. Ferguson's lawsuit argues the company's $4 billion dividend payment undercuts Albertsons' ability to compete while its sale to Kroger is reviewed.
